By creating an account or using Modeling Match, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.
1. Eligibility
You must be at least 18 years old to use Modeling Match. By using the platform, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms. If you are using the platform on behalf of an agency or business, you represent that you have authority to bind that entity to these Terms.
2. Accounts and Registration
To access most features of Modeling Match, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Keep your password secure and confidential
- Notify us immediately if you suspect unauthorized use of your account
- Not share your account credentials with others
- Be responsible for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that contain false or misleading information.
3. Model-Specific Terms
If you register as a model, you agree that:
- All photos and information you upload accurately represent you
- You own or have the right to use all content you upload, including photographs
- You grant Modeling Match a non-exclusive, royalty-free license to display your profile and photos to agencies and other users of the platform for the purpose of facilitating casting opportunities
- You are responsible for verifying the legitimacy of any agency or casting opportunity before agreeing to work with them
- Modeling Match is a discovery and communication platform — we are not a booking agency and do not guarantee employment or compensation
- Any agreements made between you and an agency are solely between you and that agency
4. Agency-Specific Terms
Agency accounts are subject to approval. If you register as an agency, you agree that:
- Your agency is a legitimate, legally operating business in the modeling and talent industry
- Casting calls you post are genuine opportunities with fair and lawful compensation
- You will not charge models fees to apply to castings or to be considered for representation
- You will comply with all applicable employment, labor, and advertising laws in the jurisdictions where you operate
- You will treat models with professionalism and respect
- You are responsible for verifying that models you hire have the right to work in the relevant jurisdiction
We reserve the right to remove any casting call or agency account that we determine, in our sole discretion, to be fraudulent, misleading, or harmful to models.
5. User Content
You retain ownership of all content you upload to Modeling Match ("User Content"). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and transmit your User Content as necessary to operate the platform.
You represent and warrant that:
- You own or have the necessary rights to all User Content you upload
- Your User Content does not infringe any third party's intellectual property, privacy, or other rights
- Your User Content does not contain nudity, explicit sexual content, or illegal material
- Your User Content is accurate and not misleading
We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, to be harmful, offensive, or inappropriate.
6. Prohibited Conduct
You agree not to:
- Use the platform for any unlawful purpose
- Post false, misleading, or fraudulent information
- Impersonate any person, agency, or entity
- Harass, threaten, or intimidate other users
- Send unsolicited commercial messages or spam
- Attempt to gain unauthorized access to other accounts or our systems
- Scrape, crawl, or systematically collect data from the platform without written permission
- Use the platform to solicit payments from models in exchange for representation or castings
- Upload content that contains malware, viruses, or harmful code
- Circumvent, disable, or interfere with security features of the platform
- Use the platform to facilitate human trafficking, exploitation, or any form of coercion
Violations may result in immediate account termination and referral to law enforcement where appropriate.
7. Messaging and Communications
Modeling Match provides a messaging system to facilitate communication between models and agencies. You agree that:
- All communications must be professional and respectful
- You will not use the messaging system to send spam, harassment, or inappropriate content
- We may review messages that are reported for violations of these Terms
- We are not responsible for the content of messages between users, but reserve the right to remove messages and suspend accounts that violate these Terms
Users can report messages they find inappropriate using the report feature. Reported messages are reviewed by our team.
8. AI Features
Modeling Match uses AI to power visual search, profile matching, and attribute analysis. You understand and agree that:
- AI-generated scores, tags, and match percentages are estimates and not guarantees of any particular outcome
- AI analysis may not always be accurate and should not be the sole basis for any business or career decision
- Photos you upload may be processed by third-party AI providers (such as OpenAI) in accordance with their terms and policies
- We do not use your photos or data to train proprietary AI models beyond the features described on the platform
9. Termination
You may delete your account at any time from your profile settings. Upon deletion, your personal data, portfolio, and messages will be permanently removed.
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, if your conduct poses a risk to other users or the platform, or if required by law. In the case of termination by us, we will make reasonable efforts to notify you.
10. Disclaimers
Modeling Match is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
- The platform will be uninterrupted, error-free, or secure
- Any casting calls or opportunities are legitimate, safe, or will result in employment
- AI match scores or recommendations will be accurate or suitable for any particular purpose
- Any user on the platform is who they claim to be
You use the platform and engage with other users entirely at your own risk. Always exercise caution and conduct your own due diligence before agreeing to any professional engagement.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Modeling Match and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the platform.
Our total liability to you for any claim arising out of or related to these Terms or the platform shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the platform shall be resolved through binding arbitration or in the courts of competent jurisdiction in the United States.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice on the platform at least 14 days before the changes take effect. Your continued use of the platform after the effective date of any updated Terms constitutes your acceptance of those changes.
